TRAIT — Terms & Conditions for Data Submission

1. Acceptance of Terms
By submitting any video, link, or related content (“Content”) to TRAIT, you confirm that you have read, understood, and agree to these Terms & Conditions and the TRAIT Privacy Policy. If you do not agree to these Terms, you must not submit any Content.
2. User Declaration and Rights
By submitting Content, you confirm that:
You are the performer shown in the Content or are authorised to submit it on their behalf.
You have the legal right to share the Content with TRAIT.
All identifiable individuals in the Content have consented to its submission and processing.
The Content does not infringe any third-party rights, including copyright, privacy, or data protection rights.
You are solely responsible for ensuring you have the necessary rights and permissions.
3. Purpose of TRAIT
TRAIT is a data-driven platform that analyses performance content, generates scores and insights, tracks talent development over time, and builds analytical datasets for research, product development, and commercial purposes.
4. Nature of Processing
By submitting Content, you agree that TRAIT may access, download, store, analyse, and derive data from the Content using automated systems and human review. This may include feature extraction, scoring, benchmarking, profiling, and the creation of derived datasets.
5. Lawful Basis for Processing
TRAIT processes personal data on one or more of the following lawful bases:
Your consent
Contractual necessity (to deliver the requested service)
Legitimate interests (including platform operation, security, fraud prevention, and the development of analytical datasets)
Where processing is based on consent, you may withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
6. Retention and Deletion
TRAIT retains personal data for as long as necessary to fulfil the purposes described in these Terms, including to maintain longitudinal performance records.
When you request deletion of your personal data, TRAIT will delete or anonymise it within a reasonable period, unless retention is required by law. Data that has already been aggregated or anonymised may be retained as it no longer constitutes personal data.
7. Licence Granted to TRAIT
You grant TRAIT a worldwide, non-exclusive, royalty-free licence to use, store, analyse, and create derived data from the Content. This licence is granted subject to your rights under applicable data protection laws, including the right to withdraw consent and request erasure. The licence does not override your data protection rights.
8. Commercial Use and Data Sharing
TRAIT may create, use, and commercialise datasets and analytical outputs derived from submitted Content. This includes selling or licensing anonymised, aggregated, or pseudonymised datasets to third parties.
Where required by law, TRAIT will provide mechanisms for you to opt out of the sale or sharing of your personal information.
9. Automated Processing and Profiling
TRAIT uses automated systems, including machine learning, to analyse Content, generate scores, rankings, and performance insights. These outputs are analytical in nature. You have the right to request human review of decisions that produce legal or similarly significant effects, where applicable under data protection law.
10. Data Minimisation and Safeguards
TRAIT applies appropriate technical and organisational measures, including pseudonymisation, access controls, and encryption, to protect personal data and reduce privacy risks.
11. Data Sharing
TRAIT may share personal data with service providers, analytics providers, and legal authorities where necessary. Where data is shared with third parties for commercial purposes, TRAIT will apply appropriate safeguards and, where required, obtain consent or provide opt-out mechanisms.
12. Business Transfers
In the event of a merger, acquisition, or sale of assets, TRAIT may transfer data to the acquiring entity, subject to applicable data protection obligations.
13. User Rights
You have the right to access, correct, delete, restrict, or object to the processing of your personal data, and to withdraw consent where processing is based on consent. Requests should be submitted via TRAIT support. TRAIT will respond in accordance with applicable data protection laws.
14. Security
TRAIT implements appropriate technical and organisational security measures to protect your data against unauthorised access, alteration, or loss.
15. Restrictions
You must not submit Content without proper rights or consent, submit unlawful Content, impersonate others, or misuse the platform. TRAIT may remove Content and suspend accounts that violate these Terms.
16. Limitation of Liability
To the extent permitted by law, TRAIT provides its services on an “as-is” basis and is not liable for decisions made based on its outputs or for any indirect or consequential damages.
17. Changes to Terms
TRAIT may update these Terms from time to time. Material changes will be notified to users. Continued use of the platform after changes constitutes acceptance of the updated Terms.
18. Age Requirements and Use by Minors
You must be at least 18 years old to submit Content independently. If you are under 18, submission is only permitted with verifiable parental or legal guardian consent. A parent or guardian must review and accept these Terms on behalf of the minor and consent to the processing of their data, including automated analysis and potential commercial use of derived data.
TRAIT may request verification of age and parental consent. The parent or guardian is responsible for supervising the minor’s use and ensuring all necessary consents have been obtained.
19. Content Ownership and Authority
By submitting Content, you warrant that you have the authority to do so and that all necessary consents have been obtained. TRAIT may implement verification measures and may notify identifiable individuals where it has reason to believe consent was not properly obtained.
20. Data Protection and GDPR Compliance
For the purposes of UK GDPR and EU GDPR, TRAIT acts as a data controller. TRAIT processes personal data in accordance with applicable data protection laws and implements appropriate safeguards, including Data Protection Impact Assessments where required.
21. California Consumer Privacy Rights (CCPA/CPRA)
If you are a California resident, you have the following rights:
The right to know what personal information is collected and how it is used or shared
The right to request deletion of your personal information
The right to opt out of the “sale” or “sharing” of your personal information
The right to non-discrimination for exercising these rights
