TRAIT — Terms & Conditions for Data Submission
1. Acceptance of Terms
By submitting any video, link, or related content (“Content”) to TRAIT, you confirm that you have read, understood, and agree to these Terms & Conditions, as well as the TRAIT Privacy Policy.
If you do not agree, you must not submit any Content. If you do not agree and still submit any Content, TRAIT will be unable to provide any service.
2. User Declaration and Rights
By submitting Content, you confirm that:
You are the performer shown in the Content, or you are authorised to submit it on behalf of the performer.
You have the legal right to share the Content with TRAIT.
All identifiable individuals appearing in the Content have consented to its submission and use as described in these Terms.
The Content does not infringe any third-party rights, including copyright, privacy, or data protection rights.
You are solely responsible for ensuring that you have the necessary rights and permissions.
3. Purpose of TRAIT
TRAIT is a data-driven platform that:
analyses performance content
generates scores, benchmarks, and insights
tracks development over time
builds analytical datasets
improves models and algorithms
develops commercial data products and services
The value of TRAIT depends on long-term datasets built from user submissions.
4. Nature of Processing
By submitting Content, you agree that TRAIT may:
access and download the Content
store the Content
analyse the Content using automated systems and human review
extract features and generate derived data
score, rank, and benchmark performance
compare Content across datasets
link multiple submissions from the same individual
maintain historical records and performance trajectories
Processing may include automated analysis, profiling, and machine learning.
5. Long-Term Storage and Trajectory Tracking
TRAIT is designed to analyse talent development over time.
You agree that:
Your Content and derived data may be retained for long-term or indefinite periods
This is necessary to ensure consistency, benchmarking accuracy, and trajectory tracking
Historical data contributes to the integrity and value of the system
You may request deletion of your data, however:
deletion may affect your ability to receive accurate future assessments
some data may be retained where necessary to preserve system integrity, prevent fraud, or comply with legal obligations
6. Lawful Basis for Processing
TRAIT processes your data based on:
your consent
the performance of a service contract
legitimate interests related to platform operation, security, and dataset integrity
By accepting these Terms, you provide explicit consent to the processing described.
7. Licence Granted to TRAIT
You grant TRAIT a worldwide, perpetual, non-exclusive, transferable, sublicensable, and royalty-free licence to:
access, download, and store the Content
copy and reproduce the Content
analyse the Content
create derived data
maintain historical datasets
integrate derived data into datasets
use datasets to operate, improve, and develop the platform
use datasets for research and development
use datasets for commercial purposes
license datasets and analytical outputs to third parties
transfer datasets as part of business assets
This licence applies to both the Content and any derived data.
TRAIT will not publicly distribute identifiable video content without additional permission.
8. Commercial Use and Data Asset Creation
You acknowledge and agree that:
TRAIT may create analytical datasets from submitted Content
These datasets may be used to develop commercial products and services
TRAIT may license datasets, models, and analytical outputs to third parties
TRAIT may generate revenue from such activities
TRAIT retains full control over revenues and profits derived from these data assets
Where possible, datasets will be anonymised or pseudonymised.
TRAIT does not sell identifiable personal data without additional consent.
9. No Compensation
You agree that:
You are not entitled to compensation, royalties, or revenue sharing from the use of your Content or derived data
unless explicitly agreed in a separate written agreement
10. Data Structure and Pseudonymisation
TRAIT may implement:
tokenisation
pseudonymisation
separation of identity and performance data
Identity information may be stored separately from Content and derived data.
This is designed to:
protect user privacy
reduce risk
enable secure dataset creation
11. Automated Processing and Profiling
You acknowledge that TRAIT may use automated systems to:
analyse performance
generate scores and rankings
classify and benchmark talent
These results are analytical and informational.
You may request human review where applicable.
12. Data Sharing
TRAIT may share data with:
service providers (e.g. cloud infrastructure)
analytics providers
identity verification providers
authorised partners (where applicable)
legal authorities (where required)
Where data is shared externally, it will be limited to what is necessary and, where possible, anonymised or pseudonymised.
13. Business Transfer
In the event of:
investment
merger
acquisition
restructuring
TRAIT may transfer data, datasets, and related assets as part of the business.
Such data will remain subject to applicable data protection obligations.
14. User Rights
You have the right to:
access your data
request correction
request deletion
restrict processing
object to certain processing
Requests may be submitted via TRAIT support.
TRAIT will respond in accordance with applicable data protection laws.
15. Security
TRAIT implements appropriate technical and organisational measures, including:
encryption
access control
pseudonymisation
secure storage
to protect your data.
16. Restrictions
You must not:
submit Content without proper rights or consent
submit unlawful or infringing Content
impersonate others
misuse the platform
TRAIT reserves the right to remove Content and suspend access if these Terms are violated.
17. Limitation of Liability
To the extent permitted by law:
TRAIT provides analysis on an “as-is” basis
TRAIT does not guarantee outcomes, rankings, or career success
TRAIT is not liable for decisions made based on its outputs
18. Changes to Terms
TRAIT may update these Terms from time to time.
Continued use of the platform constitutes acceptance of updated Terms.
19. Age Requirements and Use by Minors
19.1 Eligibility
You must be at least 18 years old to submit Content to TRAIT independently.
If you are under 18, you may only use TRAIT with the involvement and consent of a parent or legal guardian.
19.2 Submission by Minors
If you are under 18:
You must not submit any Content without parental or legal guardian consent
A parent or legal guardian must review and accept these Terms on your behalf
A parent or legal guardian must provide consent to the processing of your data
TRAIT reserves the right to request verification of age and parental consent before allowing access to the platform or processing Content.
19.3 Parental Consent
Where parental consent is required:
The parent or legal guardian must confirm that they have authority to act on behalf of the minor
The parent or legal guardian must understand and accept the nature of TRAIT’s processing, including:
performance analysis
automated scoring and profiling
long-term storage of data
trajectory tracking
dataset creation and model improvement
commercial use of derived data
TRAIT may implement reasonable measures to verify parental identity and consent, including email confirmation, account verification, or identity verification processes.
19.4 Processing of Minors’ Data
Content submitted by or relating to minors may be processed in accordance with these Terms, including:
analysis and scoring
long-term storage
inclusion in datasets
use for research and product development
use of anonymised or pseudonymised derived data in commercial datasets
TRAIT will take additional care to protect minors’ data and may apply additional safeguards where appropriate.
19.5 Restrictions for Minors
For users under 18:
Content will not be made publicly available without additional explicit consent
Use of identifiable content in demos, case studies, or promotional materials requires separate explicit permission
Certain features may be restricted or limited
19.6 Responsibility
The parent or legal guardian is responsible for:
supervising the minor’s use of TRAIT
ensuring that Content submitted complies with these Terms
ensuring that all necessary rights and permissions have been obtained
19.7 Right to Refuse or Remove Content
TRAIT reserves the right to:
refuse processing of Content involving minors where consent is unclear
request additional verification
suspend or terminate accounts
remove Content where legal or compliance concerns arise
19.8 Withdrawal of Consent
A parent or legal guardian may request:
access to the minor’s data
correction
deletion
restriction of processing
TRAIT will respond in accordance with applicable data protection laws.
Deletion of data may affect the ability to maintain historical performance tracking.
20. Content Ownership, Authority and Impersonation
20.1 Authority to Submit Content
By submitting Content, you represent and warrant that:
You are the individual shown in the Content, or
You are authorised by the individual and any relevant rights holder to submit the Content
You must have all necessary rights, permissions, and consents before submitting any Content.
20.2 No Impersonation
You must not:
submit Content while falsely representing yourself as another individual
impersonate any person or entity
submit Content in a way that misleads TRAIT as to your identity or authority
20.3 Obligation to Notify the Content Owner
Where you are not the performer:
You must notify the performer and any relevant rights holder prior to submission
You must ensure they are aware of TRAIT’s processing, including analysis, storage, and potential commercial use
By submitting Content, you confirm that such notification has been provided.
20.4 TRAIT Verification Measures
TRAIT may implement reasonable measures to verify:
identity of the uploader
authority to submit Content
ownership or rights associated with the Content
This may include:
account verification
identity verification
confirmation requests
third-party verification tools
Failure to comply may result in suspension or removal.
20.5 Notification to Affected Individuals
TRAIT reserves the right to:
notify identifiable individuals appearing in submitted Content
request confirmation of consent or ownership
provide access to relevant information regarding processing
This may be done where reasonably practicable or required by law.
20.6 Reporting and Disputes
If you believe Content has been submitted without your consent or authority, you may:
contact TRAIT to report the issue
request investigation, restriction, or removal
TRAIT may:
suspend processing
remove Content
request further verification
take appropriate action
20.7 Consequences of Breach
If you submit Content without proper authority:
TRAIT may remove the Content
your account may be suspended or terminated
you may be liable for any resulting claims, damages, or legal consequences
20.8 Limitation of Liability
To the extent permitted by law:
TRAIT is not responsible for unauthorised submissions by users
TRAIT relies on user representations of authority
TRAIT shall not be liable for claims arising from user misrepresentation
Nothing in this section limits liability where it cannot be excluded by law.
21. Data Protection and GDPR Compliance
21.1 Role of TRAIT
For the purposes of applicable data protection laws, including UK GDPR and EU GDPR, TRAIT acts as a data controller in relation to personal data submitted to the platform.
Users submitting Content act as independent parties responsible for ensuring they have the necessary rights and permissions to share such Content.
21.2 User Responsibility for Lawful Submission
You are responsible for ensuring that:
you have a lawful basis to submit any personal data contained in the Content
all identifiable individuals in the Content have provided appropriate consent
submission of the Content complies with applicable data protection and privacy laws
TRAIT does not independently verify the legal basis for each submission and relies on user representations.
21.3 Lawful Basis for Processing
TRAIT processes personal data based on:
user consent
contractual necessity (to provide the service)
legitimate interests (including platform security, fraud prevention, and system integrity)
Where required, explicit consent is obtained prior to processing.
21.4 Nature of Processing
Processing may include:
storage and retention
automated analysis and profiling
feature extraction and scoring
dataset creation
long-term trajectory tracking
research, model development, and product improvement
commercial use of anonymised or pseudonymised data
21.5 Data Minimisation and Safeguards
TRAIT implements appropriate safeguards, including:
pseudonymisation and tokenisation
separation of identity and performance data
access controls
secure storage systems
Processing is limited to what is necessary for the purposes described.
21.6 Anonymisation and Pseudonymisation
Where possible, TRAIT uses anonymised or pseudonymised data for:
dataset creation
research and development
commercialisation
TRAIT does not intentionally sell identifiable personal data without additional consent.
21.7 Limitation of Liability
To the extent permitted by law:
TRAIT is not responsible for unlawful submission of personal data by users
TRAIT is not liable for any failure by users to obtain required consent or permissions
TRAIT shall not be liable for indirect or consequential damages arising from the use of the platform
Nothing in these Terms excludes or limits liability where such limitation is not permitted by law.
21.8 Compliance Measures
TRAIT implements reasonable technical and organisational measures to comply with applicable data protection laws, including:
maintaining internal data governance practices
conducting risk assessments, including Data Protection Impact Assessments where required
enabling user rights such as access, correction, and deletion
maintaining transparency through Privacy Policy and Terms
21.9 Cooperation with Authorities
TRAIT may cooperate with regulatory authorities, including the Information Commissioner's Office, where required by law.
